1. Before deciding to participate in our program, you agree that you have read the Terms of Use of this website and the Privacy Policy.
2. Any participation in this program is voluntarily. All participants must be 18 years of age or older.
3. All works literary, musical or otherwise associated with this program are the property of Nicoletto Small Music LLC. Participants who qualify for levels involving performances agree to sign performance waivers before the recording of any video or music. By signing, participants waive any claims to copyright in the material. Participants understand that they will not be receiving any compensation for performance in the video or record, and will have to right to royalties earned therefrom. All performers on the record or video must not be non-union, or willing to fill out a union waiver for the performance.
4. Neither Nicoletto Small Music LLC, nor the individual members of Telling on Trixie are bound by the results of the polls or suggestions made in the forums. The polls and forums are meant to be suggestions only, and do not form contractual obligations.
5. By donating, participants do not create any sort of investor relationship. Donors do not expect nor will they receive any proceeds or profits from album sales, performance royalties, licensing, or any other income generated by the creation of the record or video that is the subject of this program.
6. Nicoletto Small Music, LLC reserved the right to cancel or change the rules of this program at anytime. If the rules are changed or the program is cancelled, Nicoletto Small Music will nevertheless honor the gifts and services of all donations up to that date, according to the level that was chosen by donor at the time of the donation.
7. Offers to participate are only valid for Telling on Trixie's second album and third video, which are scheduled for production during the twelve month period from May 21, 2008 to June 1, 2009. Participants in a Band with a Plan does not create eligibility for participation in future projects after June 1, 2009. Offers to participate in the program expire when the $50,000 goal has been reached or June 1, 2009, whichever is earliest.
8. Upgrades. If you want to upgrade, you just pay the difference with the same paypal email address and you'll be escalated to the level equally the sum of the payments. Feel free to contact us at info (at) abandwithaplan.com to inform us you have upgraded. Never hurts.
8. Once the $50,000 goals is reached, Nicoletto Small Music, a/k/a Telling on Trixie will begin the process of creating the prizes outlined in this program.
